Terms and Conditions for Prize Draws

1. General

Participation in a competition organised by Worms University of Applied Sciences (hereinafter referred to as ‘HS Worms’ or ‘HSW’) via our website, social media channels or by any other means is only permitted subject to these terms and conditions. The contact person and the party responsible for the competition is Worms University of Applied Sciences.

2. Eligibility

Participation is open to all natural persons with full legal capacity who are resident in Germany. Minors under the age of 16 and persons with limited legal capacity may only take part with the consent of their legal representative. For individual competitions, the minimum age may be higher; this will be stated separately in the relevant competition description. Staff members of Worms University of Applied Sciences and their relatives are excluded from taking part.

To take part in the competition, you must submit the specified task in the relevant comment field (or via the specified method of entry). Only one entry per person is permitted. Multiple entries using different accounts or identities are not permitted. By entering, you agree that your name and any content you submit (e.g. images) may be published as part of the competition. You undertake not to share any unlawful or otherwise inappropriate content and to ensure that all rights relating to your entries have been clarified. Entry is free of charge and is only permitted within the period specified in the competition description. The decision is final and no correspondence will be entered into.

3. Prize

The prize will be awarded as advertised in the competition and is non-transferable. A cash alternative or alteration of the prize is not permitted. Once the competition has ended, the winner will be notified either via a comment on their submitted entry or by email and asked to provide their delivery address. The prize will be dispatched exclusively within Germany. If you do not respond within one week of being notified of your win, the prize will be forfeited without replacement.

4. Liability

Worms University of Applied Sciences shall be liable without limitation in cases of wilful misconduct and gross negligence, as well as for damage resulting from injury to life, limb or health.

a) In cases of slight negligence, Worms University of Applied Sciences shall only be liable for breaches of essential contractual obligations (so-called cardinal obligations), the fulfilment of which is a prerequisite for achieving the objective of the competition.

b) In this case, Worms University accepts no liability for loss of profit or consequential damages.

c) Liability is also limited to typical, foreseeable damages.

d) This limitation of liability also applies, mutatis mutandis, to employees, commissioned third parties and other vicarious agents of Worms University of Applied Sciences.

Any claims arising under the German Product Liability Act or warranty claims remain unaffected. Claims for damages in connection with the competition are excluded “to the extent permitted by law”, provided there is no intentional or grossly negligent breach of duty.

Worms University of Applied Sciences shall not be liable for technical faults, force majeure or attacks by third parties that result in the competition platform becoming inaccessible. However, it shall take all reasonable measures to ensure the platform remains functional. Should technical problems arise on your device, Worms University of Applied Sciences accepts no liability for this.

5. Data Protection

In the context of the competition, Worms University of Applied Sciences adheres to the highest possible data protection standards and complies with all relevant legal provisions. Personal data is collected, stored and processed solely for the purpose of running the competition. No data will be passed on to third parties. By taking part, you expressly consent to the storage and use of your data for this purpose.

6. Severability clause

Should any individual provisions of these terms and conditions be invalid or contain omissions, the validity of the remaining provisions shall remain unaffected.

7. Jurisdiction / Applicable Law

All disputes shall be governed exclusively by German law.

8. Selection Process

The winners will be selected at random.

10. Miscellaneous
